Terms of Service

Welcome to AfterBite. By accessing or using the AfterBite mobile application ("App") or the AfterBite website at afterbite.app ("Website"), collectively referred to as the "Service," you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Description of Service

AfterBite is a bill-splitting tool that allows users to scan restaurant receipts, identify individual items, and fairly divide the total cost among a group. The Service includes AI-powered receipt scanning (available in the iOS App) and a collaborative web-based session for guests to claim items and view their share.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent.

3. User Accounts and Sessions

The App does not require account creation. Sessions are identified by device and session codes. Guest participants joining via the Website are identified by a locally generated device identifier stored in the browser.

You are responsible for maintaining the confidentiality of any session codes you create and for all activity that occurs within your sessions.

The receipt scanning feature uses artificial intelligence to interpret receipt images. While we strive for accuracy, the AI may occasionally misread items, prices, or totals. You are responsible for reviewing and correcting any inaccuracies before finalizing a bill split. AfterBite is not responsible for errors in the AI-generated output.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by AfterBite and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without express written permission.

7. User Content

When you upload a receipt image, it is processed for the sole purpose of extracting text and item data. We do not claim ownership of your receipt images. See our Privacy Policy for details on how images and data are handled.

8. Third-Party Services

The Service relies on third-party providers including, but not limited to, OpenAI (for receipt scanning) and Supabase (for data storage). Your use of the Service is also subject to the terms and policies of these providers. AfterBite is not responsible for the practices or availability of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTERBITE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

AfterBite is a convenience tool for informational purposes. It does not provide financial, legal, or tax advice. You are solely responsible for verifying the accuracy of any calculations and for settling payments among your group.

11. Indemnification

You agree to indemnify and hold harmless AfterBite and its owners from and against any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

13. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
